Unfair/Wrongful or Constructive Dismissal

Employees have the right not to be unfairly dismissed subject (in most cases) to a minimum continuous period of service 2 years’ service.  Unfair dismissal occurs when a dismissal takes place without one of the potentially fair reasons (Capability, Conduct, Redundancy, Breach of a Statutory Restriction or Some other substantial reason) for dismissal applying. If an employer establishes a potentially fair reason for dismissing an employee they also have to show that the acted reasonably in treating the chosen potentially fair reason as a sufficient reason to justify dismissing the Employee.

Whether you are an employer requiring guidance on dismissal procedure or defending a Tribunal Claim or an employee who feels they have been unfairly dismissed by their Employer and needing legal advice on the next step towards making a claim our expert team will provide clear practical advice and quality representation.
