Unlawful Deductions from Wages

The law protects individuals from having unauthorised deductions made from their wages. This protection applies both to employees and to some self-employed workers. For an employer to lawfully make deductions from wages the payment or deduction must either be:

  • required or authorised by legislation (for example, income tax or national insurance deductions)
  • authorised by the worker's contract or
  • consented to by the worker in writing before it is made.

If you are concerned that you have suffered unlawful deductions from your wages our team can assist you with your claim.  We can also provide legal advice to employers as to when deductions can and cannot be lawfully made and to defend the Employment Tribunal claims on the subject.

Contact Steve or Sally to find out how they can assist you.
